THE CONTRIBUTION OF JURITRANSLATOLOGY TO THE DEBATE ON THE QUALITY OF LEGAL TRANSLATION

 This paper aims to provide some introductory reflections on the contribution of juritraductology to the debate on the quality of legal translation. Emphasis will be placed on the right to linguistic assistance, which we will call the right to translation (written translation and interpretation) in the context of criminal proceedings, when the suspect or accused does not speak or understand the official language of the proceedings. We will initially deal with legal translation in a broad sense and then pay more attention to judicial translation, using Directives 64/2010/EU and 2012/29/EU as a paradigm. We will then discuss the importance of the quality of translation for guaranteeing the procedural rights of those under jurisdiction, but also as an instrument for the effectiveness of dialogue between foreign judges, within the scope of international judicial cooperation. Next, we will introduce the approach of the translator’s role in the judicial process. Finally, we will address the relevance of juritraductologie (juritraductology) to the debate about the quality of translation and its repercussions in the scope of Law, based on its two fundamental pillars, Translation of law and the right to translation.
